Terms & Conditions of Business

Please read these terms and conditions of sale carefully before placing your order and retain a copy of these terms and your order for future reference.

These terms and conditions of business apply to all wines and any other goods or services supplied by Renaissance Vintners Ltd to you.

1. Ordering Procedure
By placing an order you confirm that you are at least 18 years old. You may order wines, tickets to wine tastings, or other services by the methods mentioned below (unless stated otherwise).

2. Contract Terms
Your order is an offer to buy from Renaissance Vintners Ltd. Until we accept your order there will be no contract of any kind between you and Renaissance Vintners Ltd. At any point up until then we may decline to supply the goods or services to you without giving any reason. At the moment we accept your order a contract will be made between you and Renaissance Vintners Ltd.

3. Description & Prices
The description and prices payable for the items or services that you order are set out in our price list and website. If, by mistake, we have under-priced an item or service, we will not be liable to provide that item to you at the stated price. We reserve the right to change our prices. Please refer to the latest price list, offer or to our website for all current prices.

All prices for wines are quoted per case, as packed. Wines that are offered In Bond (IB) are not subject to Duty or VAT unless they are taken out of bond. If taken out of bond, wines that have been offered in bond will be subject to Duty and VAT at the prevailing rate. The price for wines that are offered Duty Paid do not include VAT. VAT will be charged on Duty Paid sales of wines that are taken out of bond.

Prices are subject to currency and market fluctuations and changes in Duty and VAT. Payments made from Overseas Bank Accounts may be subject to additional Bank Charges all of which are to be met by yourself. Any shortfall in payment received in GBP, will delay the release of your purchase.

4. How to Pay
We will only accept payment by electronic bank transfer in GBP. We will not release goods or services until cleared funds have been received in our account.

We do not offer credit terms.

5. Delivery

Duty Paid deliveries are charged at cost. Please check delivery charges with us at the time of placing your order.

Whilst we will endeavour to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

6. Quality and Liability
Renaissance Vintners Ltd aim to provide our customers with an unsurpassed level of service. Wines sold by Renaissance Vintners Ltd are sold ‘as described’ on our website, in offers or on our wine list. In the event that any case or bottle of wine sold by Renaissance Vintners Ltd is proven not to be ‘as described’, we offer to credit you in full (at your invoice value for that case or bottle only) provided the bottle or case in question is returned to and received by Renaissance Vintners Ltd within 14 days of the recorded date on the Proof of Delivery note. The maximum liability accepted by Renaissance Vintners Ltd is for the value of the individual case or bottle which is proven not to be as described. You accept that Renaissance Vintners Ltd are not responsible for wines that prove to be corked or faulty. In addition, if a wine has been kept too long or stored inappropriately, you accept that we will not be able to offer a refund.
Renaissance Vintners Ltd are aware that customers may purchase wines or other goods for any number of purposes including, but not limited to, immediate private consumption, to improve or complete a collection, to include in tasting events or perhaps to sell onto another party. Whatever your reason for buying wines or other goods, you accept that Renaissance Vintners Ltd are not liable for any losses arising from any such subsequent activities. We advise customers prior to incurring additional costs or any direct or indirect liabilities that they first order and take delivery of the wines or other goods in question and assure themselves of their authenticity and condition.

7. Availability
All wines are subject to availability.

8. Ownership
All wines remain the property of Renaissance Vintners Ltd. or its associates until payment is received in full.

9. Export Orders
Renaissance Vintners Ltd are happy to accept orders for export. Renaissance Vintners Ltd will release wines for collection to be exported by your nominated shipper only when payment has been received in full. Any fees arising from the preparation of Collection invoices and/or Export documentation must be settled by yourself prior to release. At our discretion Renaissance Vintners Ltd may agree to arrange shipment on your behalf, depending on the order value and destination. Should Renaissance Vintners Ltd arrange a shipment on your behalf, Renaissance Vintners Ltd will charge you the cost of shipment and any additional processing fee levied on Renaissance Vintners. All costs must be settled in full before release of the wine.

Overseas orders may be liable to import taxes in the destination country, for which the recipient shall be liable unless agreed in writing at time of placing the order and paid in full in advance.

10. Broking
Renaissance Vintners Ltd offer a wine brokerage service. We will seek third party buyers for your wine. If we agree a sale of your wine to a third party we will purchase your wine from you and then sell it on to the third party. Our purchase from you will be conditional upon the third party purchasing and completing the purchase of the wine from Renaissance Vintners Ltd.
You may instruct Renaissance Vintners Ltd to sell wines on your behalf by giving a written instruction by email to enquiries@renaissancevintners.com or by in writing to RENAISSANCE VINTNERS LTD, 13 Inverness Terrace, Broadstairs, Kent CT10 1QZ. When you instruct Renaissance Vintners Ltd to sell wines on your behalf you confirm your acceptance of these terms and conditions (unless otherwise stated and agreed).

In agreeing to Renaissance Vintners Ltd broking terms, you are authorising and granting Renaissance Vintners Ltd a minimum one month exclusivity on being able to offer your wine(s) for general sale. We will agree a price which we will pay you for the wine. If we sell the wine to a third party then our purchase from you will be deemed to have occurred immediately before the sale. The sum agreed payable to you will be paid within 30 working days of the receipt by us of the proceeds of our sale to the third party. If the wine has not been sold within one month, Renaissance Vintners Ltd will contact you to discuss a renewal of the period and/or a price adjustment, or the return of the wine to you. Renaissance Vintners Ltd may, at our discretion, agree a longer or shorter period of exclusivity with you on the sale of your wines or different payment terms with you as circumstances require. The purchase and resale of your wines is conditional on their safe receipt and that the condition of the wines is, in the opinion of Renaissance Vintners Ltd, as agreed and suitable for resale. Typically, if you are offering wines for broking from outside Renaissance Vintners Ltd own storage facilities then the wines must be in original case (OWC or OC) and in good condition. We may introduce additional terms and conditions in relation to the brokerage service which will be advised to you at the time. Renaissance Vintners Ltd charges a minimum brokerage commission of £25.00 per case.

If any condition report/photographs of your wines are required for a sale, the cost of photos of the condition of your stock would fall to yourself as the stock owner, before any sale could be concluded. Please check your own warehouse costs for condition report/photography.

Where the purchaser cancels the sale contract (where they are permitted by law to do so) Renaissance Vintners Ltd has the option to cancel the contract for the purchase of the wine from you, by written notice to you (including e-mail). Where payment is withheld by the purchaser and goods are to be returned (either by the purchaser or at your request prior to the sale; or where the wines cannot be sold or the contract is cancelled), transportation to you of the wine will be at your expense using Renaissance Vintners Ltd standard delivery charges.

If Renaissance Vintners Ltd makes an error regarding the sale of a case of wine belonging to you, Renaissance Vintners will bear the error.  If the warehouse storing your wines makes an error, Renaissance Vintners would endeavour to support your claim to have the warehouse provide recompense.  However, if you ask Renaissance Vintners Ltd to sell a wine which later proves not to be available after we have issued an invoice for it, you will be liable to cover the cost of replacing the wine that has been invoiced for sale.  We ask that you note this liability before entering into any agreement with Renaissance Vintners Ltd to sell wines on your behalf.

11. Wine Tasting & Dinner Tickets

In the event that you wish to cancel tickets you have bought for a Renaissance Vintners Ltd event, full refunds will only be given if we are notified at least 28 days before the date of the event. Refunds will only be given after this time if we are able to re-sell your tickets.
All attendees of Renaissance Vintners Ltd ticketed events must be 18 years or older.

12. Privacy Policy
Please note that in certain cases we may run a credit check on customers; this will be kept confidential. Alternatively if you register for some of our services we may collect information about you to provide such services. You have a right of access to all information we hold about you.

13. Verification Checks
To ensure that your credit, debit or charge card is not being used without your consent, we may validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. This is done only to confirm your identity and to perform a credit check. All information provided by you will be treated in accordance with the Data Protection Act 1998. All information revealed through such checks shall be used by us in accordance with our Privacy Policy although we may refer any information which appears to be fraudulent or unlawful to relevant third parties such as police or other enforcement authorities, banks, credit card companies as may be appropriate.

14. Other services, exclusive offers etc
Renaissance Vintners Ltd may offer other services, exclusive offers, discounts, promotions etc together with services not specifically referred to in these terms and conditions. Such matters shall be subject, in addition to these terms and conditions, to specific terms and conditions relating to such matters. By taking the service or exclusive offer, discount, or promotion you agree to be bound by such additional terms and conditions.

15. Applicable Law
These Terms and Conditions will be subject to the laws of England and Wales. We aim to solve disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so through the English Courts. Nothing in these terms and conditions limits or excludes your statutory rights as a consumer. These terms and conditions are subject to amendment – please refer to our website.

16. Interpretation
Reference to “we” means Renaissance Vintners Ltd.
Reference to “you”, “yours” and “yourself” in these terms and conditions denotes ‘a customer of Renaissance Vintners Ltd’. A customer is any party who purchases wines from Renaissance Vintners, supplies wines to Renaissance Vintners Ltd or enters into an agreement whereby Renaissance Vintners sells wines on their behalf (see clause 10 – Broking). The headings in these Terms & Conditions are only for convenience and do not affect their interpretation.
Reference to “OWC” means Original Wooden Case and “OC” means Original Carton.

All communications between Renaissance Vintners Ltd and its customers will be conducted in the English language. Each of the clauses of the Terms & Conditions shall be severable and distinct from every other and if at any time any one or more of these clauses (or any part thereof) is or becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining clauses shall not in any way be affected or impaired.
